Simmons Patents agrees to represent its client, F. C. Patents, owner of intellectual property rights covering Fire Service Fixture technology, against apparent third party attempts to fraudulently acquire ownership rights in same.  At the present time only Mueller Water Products and MARS Water have legal license to manufacture, offer for sale, and use products covered by F. C. Patents’ intellectual property rights in their Fire Service Fixture technology.

Simmons Patents successfully represented its client, Wyatt Seals, owner of “Moto Works Racing”, in opposition proceedings 91199471, and 91199473.  Wyatt Seals decided to sell the mark “Moto Works” for a substantial amount of money and will now operate his motorcycle and ATV tuning services under the trademark “SR1”.


April 12, 2011

The Patent infringement case (3:11-cv-00116) between F.C. Patents and The Ford Meter Box Company, with regard to Design Patent D612,465, covering the ornamental design of a “Fire Service Fixture” device, has been resolved.  Simmons Patents performed a risk benefit analysis, and based on such analysis, recommended that Plaintiff, F.C. Patents, dismiss the suit as the currently available evidence indicated that there were insufficient sales and associated damages to support the suit.  F.C. Patent did not grant a license to The Ford Meter Box Company.  This issue will likely be revisited within a year after the USPTO issues a utility patent covering the “Fire Service Fixture” device.

Simmons Patents agrees to represent Rapid Water Recovery, LLC (a Simmons Patents’ client) in the sell and/or protection of a patent family relating to check valves for flow meters. 


December 28, 2010

 

Simmons Patents agrees to represent individual inventor Ron Chapman in a patent infringement case for a product described in U.S. Patent Application 12/263,455 relating to a Material Conditioner.

 
December 23, 2010 : FC Patents v. Mueller et al.

Counsels for Mueller Water Products and Simmons Patents successfully negotiated a mutually beneficial settlement agreement for their respective clients.

Details of such settlement agreement are confidential.  That said, it can be disclosed that Mueller Water Products et al. now have license to manufacturer, offer for sale, and sell any product covered by United States Design Patent No. D612,465.   (the parties agreed to a joint stipulation of dismissal with prejudice -- see -- file number 6:10-cv-01422).

November 2008 : MARS Water v Infinity Metering Company, et al.

The parties enter into a settlement agreement.  MARS Water grants a non-exclusive license to James Baker to use the "Dual Magnetic Field Sensor Unit" invention claimed in US Patent 7,245,230.  Terms of the license agreement are confidential.

Simmons Patents agrees to represent Moto Works Racing in a Trademark dispute.

 
June 2007 

Simmons Patents represented David Baulieu in a copyright infringement cause of action regarding the architectural work embodied in a set of schematic drawings titled: Haven Plan Elevation "A":(Registration Number: VAu667-607). This case settled pre-litigation.
