Schlumberger Resource Management Services Inc. v. ABB Automation Inc. (D. Del. 2003).


William Simmons was a member of a four attorney team that obtained a jury verdict of $7.3 million for Schlumberger in a patent infringement action involving electrical meters where the ABB "Alpha" meter was found to infringe three Schlumberger patents.  Elster was represented by Woodcock Washburn.


The above case involved eleven (11) patents and Mr. Simmons helped develop legal strategies, participated in all phases of discovery, generated infringement opinions, and validity opinions regarding such patents.  In addition, Mr. Simmons help develop and present a four day in court room demonstration comparing the Alpha meter operation to the relevant patented technology.

Wookcock Washburn obtained a jury verdict of $22.3 million for Elster Electricity in a patent infringement action involving electrical meters.


While the above result was very disappointing, Mr. Simmons enjoyed numerous victories along the road to trial.  The above case initially involved twelve (12) patents including the Munday et al. 5,457,621 patent.  Mr. Simmons help develop the legal strategies and draft dispositive motions that eliminated all but two (2) patents before the trial stage. Regarding Munday et al., Mr. Simmons help develop the legal basis for filing a motion resulting in the Munday et al. patent being held invalid; a decision that was upheld on appeal.
